A ROCKHAMPTON judge last week found an assault on a Biloela teacher was an excessive act of self defence.
Adam Troy Walker, 29, walked free on Friday after pleading guilty to one count of causing grievous bodily harm on March 28, 2010.
The court heard the victim, Richard Jeffers, confronted Walker angrily after he overheard him make a comment to his friend about teachers.
Walker did not know Mr Jeffers or that he was a teacher.
Judge Paul Smith said Walker delivered a single blow to Mr Jeffers, who fell back and hit his head on the concrete.
He suffered from bruising and pressure on his brain, as well as a fractured skull, and spent 17 days in intensive care.
"This is a case of an unlucky punch," Judge Smith said.
Judge Smith said he accepted this was out of character for Walker.
He sentenced him to 18 months jail, suspended immediately for three years. He also ordered Walker to pay $25,000 in compensation to Mr Jeffers.
