Man chucks bottles at liquor shop attendant

GRIEVING over the death of his dog, a normally well-behaved Ryan Rees Elliott got angry in a liquor shop at perceived rudeness and chucked bottles at the attendant, causing him a head injury.

Elliott (pictured), 26, a painter and rigger, claims to dislike rudeness and the reason he threw the three bottles of alcohol at the attendant was that he was rude and disrespectful.

Police prosecutor Snr Const Sam Pyke told Gladstone Magistrates Court the victim was taken by paramedics to hospital and received stitches to a head wound after being struck by a bottle at 7.20pm on July 10.

Elliott pleaded guilty to assault causing bodily harm when intoxicated at the Reef Hotel bottle shop on July 10, and causing wilful damage.

Snr Const Pyke said Elliott was abusive to the bottle shop attendant and told to leave, but later walked back and abused the man before throwing three bottles at him.

The third struck him on the back of the head.

Snr Const Pyke said Elliott went around the counter where the attendant had ducked for cover and punched him.

Elliott was restrained in a headlock and police found the attendant bleeding profusely from a head wound.

Elliott told police he had only had four drinks.

"He says the attendant was rude to him and that he does not tolerate rude behaviour, Snr Const Pyke said.

The prosecutor said the attendant sought compensation for a smashed iPhone and the hotel sought $181 for the broken bottles.

Defence lawyer Kylie Devney said Elliott had no excuse but poor judgement.

Magistrate Penelope Hay said it was very fortunate the injuries had not been worse, and warned that in such assaults people did go to jail.

She had given a jail penalty "serious consideration".

"You must have been very thin-skinned not to have restrained yourself," she said.

Elliott was sentenced to a 12 months probation order and must do counselling, grief and anger management.

He was ordered to pay $500 to the victim. A conviction was not recorded.
