ABC head's case continues
A JURY will begin deliberating in the case against a former ABC Learning Centre head next week.
Former childcare mogul Martin Vincent Kemp has pleaded not guilty to dishonestly exercising his powers to personally gain more than $3 million from ABC Learning Centres to pay his debts.
Kemp, who was executive director of ABC's Australia and New Zealand arm, is accused of arranging for ABC to buy three childcare centres and freehold land he controlled between January 9 and 12, 2008.
He allegedly failed to disclose the conflict of interest to the board and did not act in good faith in the best interests of the company.
Defence barrister Neil Clelland told the jury in Brisbane District Court on Friday they should pay close attention to the authority the company's chief Eddie Groves held.
He pointed to documents showing the board had delegated many decisions to management and evidence from witnesses who had testified Mr Groves' authority was "unlimited".
Commonwealth prosecutor Alan Macsporran had told the jury the Crown would prove the Corporations Act breaches were "deliberate" with the "intention of obtaining a benefit for himself".
The case continues Monday.
